As a followup to my bugreport here:

Jeff’s response was that it’s intentional because the option is rarely used. Unfortunately this leaves a problem for those people who do use the checkbox, and I don’t think it’s a negligible number.

Therefore, to appease both sides, how about we move the checkbox underneath the button (and then restore the tab order to normal)?

Notice: My main issue is not that I use the option (although I do). My main issue is that the unexpected tab order causes frustration, not just for me but for everyone. Every time a user tries to check the checkbox they will accidentally submit by pressing the button, and every time they didn’t want to check the checkbox they inadvertantly tab past the button and have to tab back. I’m beginning to get used to it, but every other user who uses the Tab key will go through the same tirade and get annoyed every time. It is bad UI to require the user to get used to this instead of simply following the established convention which everyone expects.

It wouldn't be very good UI design to move that checkbox below the submit button. Even though it is small and only one item, it's still not very intuitive a location.

A user should not have to navigate past the "end action" of a form to fill out additional items and subsequently navigate back to actually submit the form. When they reach the submit button, they should have already encountered and addressed all elements that are relevant to that form.

I know all that. The normal solution that any reasonable UI designer would recommend is, of course, to just fix the tab order. But as I said in this question, this was declined, so I’m suggesting a compromise. – Timwi Aug 30 '10 at 16:40
@Timwi If the problem is, to quote your closing, "It is bad UI to require the user to get used to this instead of simply following the established convention which everyone expects.", then why should the compromise be simply a different bad UI that requires the user to be adjusted to something instead of following established conventions that people expect? – Grace Note Aug 30 '10 at 16:43
The only change that really occurs is which class of users gets spited by the system. As such, is it really a better idea to spite the set of users affected by this alternate method? And if so, how do you back up that it would be better that way? – Grace Note Aug 30 '10 at 16:46

@Jon I understand that, but how can we say it is the lesser of two evils when we don't actually have anything to back that up? An un-backed suggestion is far less likely to get consideration for implementation. – Grace Note Aug 30 '10 at 16:54
@Grace Note: It is the lesser of two evils because in my suggestion the tab order is correct, thus the Tab key behaves as expected from visually scanning the UI. In the current system, the tab order is incorrect, causing users to “press the wrong button” out of habit, and doing so over and over again, and getting frustrated about it every time. – Timwi Aug 31 '10 at 7:19
@Timwi But in your suggestion, while the Tab key behaves as expected, the form as a whole does not behave as expected. The expected conclusion element is now in the middle of the form; moreover, even Tab users will have to tab past the conclusion element to fill out those fields. I imagine that this still won't fix the issue; it'll only make it less obvious to the user that they were skipping checkboxes in the first place. Thus far, your justification for it being the lesser evil appears to be anecdotal - where are all the numbers of users who are actually stumbling over this? – Grace Note Aug 31 '10 at 12:29
@Grace Note: I already said I don’t like the compromise either, I don’t know what else you expect me to say. I think I’ll delete this post, since it’s obviously unpopular and taking the effort to find a compromise is obviously not appreciated. – Timwi Sep 1 '10 at 21:44
