FWIW, it's not that the system excludes the user's own posts from the check, as I just tried to submit a question with the same titles as one of my previous, and it got rejected. – Matt Nov 11 '11 at 16:16

Either the title was edited in the 5-minute window, or some content (which caused the titles to not match) was stripped before posting.

Automatic title edits

The fact that stripping content can cause duplicate titles was published here:

... It's interesting though that, having added a dummy trailing "." to the new title for the time being, it was automatically stripped... and of course now the title is a duplicate title anyway. :) – Tomalak Geret'kal Sep 27 at 17:34

Edits in the grace period

The fact that editing in the 5-minute window can cause duplicate titles has also been confirmed. I just tested editing in the 5-minute window on my SE 2.0 site's meta to confirm that this was allowed. I'll probably delete these questions shortly to remove the noise, but you can see them for now:

I don't believe that there are rep or moderator exceptions to this rule. In the same comment exchange, Marc wrote, responding to a post in which an editor inadvertantly created a duplicate title by removing a tag from the title:

@Tomalak if you didn't change the title, then that is a bug. Are you sure? If so, that will be fixed. – Marc Gravell♦ Sep 27 at 17:28

From this I gather that editing the title should ordinarily trigger the restriction.

In either case, it's a reproducible bug.

@NullUserExceptionஇ_இ - Anything is possible; I didn't want to litter on MSO (where I have 4k of rep, which might bypass the restriction) or some random meta site where I'd have 101 (and it might not be applied on metas), or some random main site as a 1-rep user (where I'd just be annoying). Maybe I should have stated that I don't believe that there should be rep or moderator exceptions to this rule? – Kevin Vermeer Nov 11 '11 at 16:55
I know for a fact that rep is not a factor. I can't post questions with duplicate titles on SO, and I have ~26k there. – NullUserException อ_อ Nov 11 '11 at 16:57
